No Muslim should feel comfortable sleeping at night without having prepared a Will. We never know when we will die, and the Will is an important instrament to ensure that your wishes are respected after you die.

Most people do not realise that the Islamic will deals with more than just how your wealth and children are dealt with after your dealth.

It also deals with after aspects that are just as important, such as:

  • How you want to be buried
  • How you would like to be wahed
  • What you would like your grave to look like
  • Dealing with Debts
  • etc

This is especially true for every Hajji, please ensure you have a will before leaving for Hajj.

This sample will is to be used as a guide for creating you own will. It is a good sample to start off with, but it can not cover everything to do with every person.

There are 2 documents, one is the Will and the second describes important issues to deal with the will. Please ensure you read through both.

The Will have be designed to address Islamic and Australian Law.

Please Note:

The Aussie probate system doesn't really ensure that the burial of the deceased is the same as requested in his or her Will and is mainly concerned with the distribution of the deceased's assets ( we have some stories from the community on how ashes have been disposed of).

However is put in Will as requests. We have left the Islamic parts regarding the burial in there so if there ever happens to be a dispute at least the members on the side of the Islamic burial may have the upper hand as the format of burial is requested in the Will.

Please also note that even though this a legal Will; we would still prefer people not to use a generic Will due to the fact it leaves a lot of clauses to suit the testator's particular circumstances regarding their assets and beneficiaries, infant children trusts, preferred guardianship of infant children etc.

Its just to time consuming to bring everything in one hit and will make it extremely long for everything to be included but can be done on requests. However should go through courts if kept up to date i.e. list of beneficiaries are current and none are dead, without to much of a headache for the executor.
